These Terms of Service (“Terms”) govern your access to and use of the services, website, mobile ordering, delivery, and pickup offered by Dhaka Food Express & Deli Bronx (the “Restaurant”, “we”, “us” or “our”). By placing an order, creating an account, using our site or otherwise interacting with our services, you agree to these Terms. If you do not agree, do not use our services.

1. Definitions

  • Customer / You / User: Any person who places an order, uses the website or interacts with our services. 
  • Order: A request for food, beverage or other goods placed through our website, app, by phone, or in person. 
  • Delivery Partner / Third Party: Any independent contractor or platform (e.g., third-party delivery services, payment processors) we use to process, deliver, or facilitate orders.

2. Acceptance of Terms

By ordering or using our site, you confirm you are at least 18 years old (or have parental consent where required), can form binding contracts, and accept these Terms. We may refuse service, terminate accounts, or cancel orders at our discretion, where permitted by applicable law. 

3. Orders, Confirmation & Preparation

  • Orders placed online, by phone, or in-person are subject to confirmation. Preparation may begin as soon as an order is confirmed. 
  • Order confirmations are sent by email/SMS/onscreen (depending on channel). Please check the confirmation carefully and contact us immediately for changes. 
  • We aim to prepare orders promptly, but preparation and delivery times are estimates and not guaranteed. 

4. Prices, Taxes & Payment

  • All prices shown are in the currency indicated on the site and may not include taxes, delivery fees, service fees, or tips. These amounts will be shown at checkout. 
  • We reserve the right to correct pricing errors. If an incorrect price is displayed and you have already been charged, we will contact you to confirm whether you want to proceed at the correct price or cancel the order. 
  • Payment methods accepted will be displayed on the site. By providing payment information you represent and guarantee that you are authorized to use the payment method. 
  • For online card payments, your bank or card issuer may place authorization holds; final settlement timing is subject to your bank and our processor. 

5. Delivery & Pickup

  • Delivery areas, fees, and estimated times are provided at checkout and are subject to change. 
  • Delivery is to the address provided at the time of ordering. We are not responsible for late or failed deliveries caused by incorrect addresses, inaccessible locations, or force majeure events (bad weather, traffic, public emergencies). 
  • For pickup orders, items should be collected within the pickup window specified. Uncollected orders may be disposed of after a reasonable holding period; refunds for uncollected items are at our discretion. 

6. Menu, Allergens & Dietary Information

  • Menu items, descriptions, and ingredients are provided for convenience but may change. We do not guarantee the absence of allergens due to cross-contact risks in our kitchen. 
  • If you have food allergies or dietary restrictions, you must inform us when ordering. We will make reasonable efforts to accommodate requests but cannot guarantee an allergen-free environment. 
  • Nutritional or caloric information is approximate and should not be relied upon for medical or dietary decisions. 

7. User Accounts & Conduct

  • When you create an account, you agree to provide accurate information and keep login credentials secure. You are responsible for activity that occurs under your account. 
  • You must not use our services for unlawful purposes, abuse or harass staff, interfere with service operations, or post false reviews. 
  • We reserve the right to suspend or terminate accounts that violate these Terms. 

8. Promotions, Coupons & Loyalty

  • Promotions, discount codes, and loyalty offer have specific terms and expiry dates. Only one coupon may be applied per order unless stated otherwise. 
  • Offers cannot be combined with other promotions unless explicitly allowed. 
  • The restaurant reserves the right to modify, cancel or refuse promotions at any time. 

9. Third-Party Platforms & Partners

  • We may work with third-party delivery platforms, payment processors, and marketplaces. The use of those platforms is also subject to their terms and privacy policies. 
  • We are not responsible for the acts or omissions of third parties (e.g., a delivery partner’s conduct). If you use a third-party platform to order from us, follow that platform’s procedures for complaints and refunds as applicable. 

10. Intellectual Property

All content on our website and marketing materials (text, logos, images, menus) is owned or licensed by Dhaka Food Express & Deli. You may not copy, reproduce, or use our intellectual property without our prior written consent. 

11. Limitation of Liability

  • To the fullest extent permitted by law, Dhaka Food Express & Deli Bronx and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services. 
  • Our aggregate liability for any claim related to an order or our services will not exceed the total amount paid by you for the specific order giving rise to the claim, except where prohibited by law. 

12. Indemnification

You agree to indemnify, defend, and hold harmless Dhaka Food Express & Deli Bronx and its employees, agents, and partners from any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms or your use of our services. 

13. Dispute Resolution & Governing Law

  • These Terms are governed by the laws of the State of New York (without regard to conflict of law rules). 
  • For disputes, we encourage you to contact us first to attempt informal resolution. If unresolved, disputes will be resolved in the courts located in the County of the Restaurant’s primary location (Bronx, NY), unless you and we agree to arbitration in writing. Some consumer protections may not be waived by arbitration — consult legal counsel for details. 

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms with a new effective date. Continued use of our services after changes constitutes acceptance of the updated Terms. 

15. Privacy

We collect and process personal information according to our Privacy Policy; please review that to understand how we handle your data. By using our services, you consent to the collection and use described in the Privacy Policy. 

16. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
